Public Notice For Proposed National Cement Title V Permit

Pursuant to District Rule 201.1 (Permits to Operate for Sources Subject to Title V (TV) of the Federal Clean Air Act Amendment of 1990), a Federal Part 70 Permit Renewal has been drafted for the National Cement Lebec Plant located at Section 35, Township 9 North, and Range 18 West. This plant produces Portland Cement.   

Permitting Action

EKAPCD issued an initial TV Permit to Operate to this facility in 2000. The purpose of this permitting action is to update and renew National Cement’s previous TV permit. Once issued by the EKAPCD and the U.S. Environmental Protection Agency, this permit will be valid for five years

Public Comment Procedures

Copies of the application for TV renewal, draft permits, support documents, and the District’s analysis are available for inspection at the Eastern Kern Air Pollution Control District Administrative office located at the Public Services Building, 2700 “M” Street Suite 302, Bakersfield, California. The District’s analysis includes a statement of legal and factual basis for the proposed conditions and references to applicable statutory and regulatory provisions.

Comments can be submitted in writing to the EKAPCD at the address list above. All comments must be received by 5:00 PM on March 2, 2012. Members of the public may request the Air Pollution Control Officer preside over a public hearing for the purpose of receiving public oral comments. Issues raised during the public comment period will be addressed in writing by the EKAPCD before the renewal permit is issued. The permits and all comments will be forwarded to US EPA Region IX and will be available for review after the 30-day public review process is complete.

Pursuant to District Rule 201.1 (Permits to Operate for Sources Subject to Title V (TV) of the Federal Clean Air Act Amendment of 1990), a Federal Part 70 Permit Renewal has been drafted US Borax, Inc, 14486 Borax Rd, Boron, CA. Borate mining and processing is performed at this facility.

Public Notice for EKAPCD CEQA Greenhouse Gas Policy

NOTICE IS HEREBY GIVEN a public hearing will be held on March 8, 2012, 1:00 pm at Ridgecrest City Hall, 100 W California Ave, Ridgecrest, CA. At the hearing the Eastern Kern Air Pollution Control District (EKAPCD) Governing Board will consider adoption of an addendum to the EKAPCD California Environmental Quality Act (CEQA) Guidelines titled: “Addressing GHG Emission Impacts for Stationary Source Projects When Serving as the Lead CEQA Agency.”  This addendum is the policy that the EKAPCD will use when it is the lead agency for CEQA to determine the significance of Greenhouse Gas (GHG) emissions from new and modified stationary source (industrial) projects.

PUBLIC COMMENT PROCEDURES:  A copy of the proposed CEQA addendum is available for inspection at the EKAPCD office, 2700 M St, Ste 302, Bakersfield, CA, public libraries within the EKAPCD and on the link below.

Comments can be submitted in writing to the EKAPCD at the address list above or emailed to ekapcd@co.kern.ca.us.  All comments must be received by 5:00 PM on March 7, 2012. Interested persons may appear at the hearing and present comments.

Public Notice for EKAPCD Rule Adoption

A public hearing was held on January 12, 2012, 1:00 pm at Golden Hills Community Services District, 21415 Reeves, Tehachapi, CA. At the hearing the Eastern Kern Air Pollution Control District Governing Board adopted the following amended rules and one new greenhouse gas fee rule:

Adopted Fee Rule 301.4, Greenhouse Gas Fee

A public rule development workshop was held November 9, 2011 at the Rosamond CSD in Rosamond, CA. The California Air Resources Board (ARB) and the US Environmental Protection Agency (EPA) also reviewed the proposals. All comments were considered and addressed in the amended rules and draft rule in each rule’s respective staff report.

Adopted, Rule 210.4, PSD will be submitted through ARB to EPA for incorporation as part of the California State Implementation Plan (SIP). This action would constitute a SIP revision. Rules 201.1, 201.2, and 201.3 will be submitted through ARB to EPA for incorporation into the EKAPCDs Title V Rules. Amendments to Rules 201.1, 201.2, 201.3 and 210.4 will not become effective until approved by EPA. Rule 301.4 has become effective upon adoption.

An updated rules package containing the amended rules and new draft rule will be mailed to EKAPCD Title V permitted sources.

 

2012 Motor Vehicle Emission Reduction Program

EKAPCD’s 2012 Motor Vehicle Emission Reduction Program (MVERP) deadline for project proposals ended 1/13/2012. The MVERP Committee meeting will be held in March 2012. Date, time, and location will be announced once confirmed.

 

ARB Audit Report of EKAPCD’s Carl Moyer Program

ARB’s audit of EKAPCD’s Carl Moyer Program resulted in no findings or recommendations. ARB states “EKAPCD’s Carl Moyer Program is achieving the emission reductions intended and is meeting State requirements”.  A complete copy of ARB’s Audit Report and EKAPCD’s response is located below.

6/30/2011 Revised Off-Road Diesel Vehicle Regulation FACT Sheet
The Air Resources Board (ARB) released a revised Off-Road Diesel Vehicle Regulation FACT Sheet dated May 2011. The revised FACT Sheet reflects the Board approved changes to the Off-Road Diesel Vehicle Regulation. The regulation imposes limits on idling, buying older off-road diesel vehicles, and selling vehicles beginning in 2008; requires all vehicles to be reported to ARB and labeled in 2009; and then in 2014 begins gradual requirements for fleets to clean up their fleet by getting rid of older engines, using newer engines, and installing exhaust retrofits.

6/16/2011 Clean Vehicle Rebates
In response to overwhelming consumer demand and to increase the number of rebates available, ARB is proposing to triple the funding allocation for the rebate program next fiscal year to between $12 million and $17 million, and reduce the rebate amount by half -- from $5,000 to $2,500 -- in order to meet increasing demand.The additional funding is projected to allow for approximately Chevy Volt6,000rebates--four times the numberfunded this year. However, even with the anticipated increased number of rebates available, this funding is limited and may not be sufficient to meet consumer demand next year, so consumers are encouraged to apply early.

3/10/2011 $100 million offered for trucks used in goods movementTruck
Six Air Districts are offering over $100 million in financial incentives to owners of trucks used in goods movement to upgrade to cleaner technologies through truck replacement with cleaner diesel or alternative fuel models, engine replacement, or retrofit installation.

Low Carbon FuelCalifornia Air Resources Board (ARB) staff will implement in 2011 the 0.25% carbon-intensity (CI) reduction requirement with recognition of the need to recognize reasonable, good-faith compliance efforts while focusing enforcement actions on willful, intentional, egregious, or other substantial and material violations of the LCFS regulation.
